General Terms and Conditions (GTC)

1. Scope of Application

The following GTC apply to all orders placed via our online shop. Our online shop is directed exclusively at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Contractual Partner, Conclusion of Contract, Correction Options

The purchase contract is concluded with Lukas Hahn, HeuteShop. By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after sending the order, you will receive another confirmation by email.

3. Contract Language, Storage of Contract Text

The language(s) available for the conclusion of the contract: English, German. We store the text of the contract and send you the order data and our GTC in text form. For security reasons, the text of the contract is no longer accessible via the internet.

 

4. Delivery Conditions

Shipping costs may apply in addition to the stated product prices. Detailed provisions on any shipping costs can be found in the offers. We only deliver by shipping. Collection of the goods by the customer is unfortunately not possible.

 

5. Payment

The following payment methods are generally available in our shop:

 

  • Credit Card: Your card will be charged immediately after placing the order.

     

  • PayPal: You pay the invoice amount via the online provider PayPal. You must be registered there and confirm the payment instruction to us.

  • Google Pay / Apple Pay: Payment via the respective mobile payment services.

  • Klarna: In cooperation with Klarna Bank AB, we offer "Purchase on account." Payment is made to Klarna. Please note that Klarna may perform a credit check.

6. Retention of Title

The goods remain our property until full payment has been made.

7. Damage in Transit

If goods are delivered with obvious transport damage, please complain about such errors to the delivery agent as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, it helps us to be able to assert our own claims against the carrier or the transport insurance.

8. Warranty and Guarantees

8.1 Statutory Warranty: The statutory liability for defects applies. 8.2 Guarantees: Information on any additional guarantees that may apply and their exact conditions can be found with the product and on special information pages in the online shop.

9. Liability

We are always liable without limitation for claims based on damage caused by us, our legal representatives, or vicarious agents:

  • In the event of injury to life, limb, or health.

  • In the event of intentional or grossly negligent breach of duty.

  • In the case of guarantee promises, insofar as agreed. In the event of a breach of essential contractual obligations (cardinal obligations) through slight negligence, liability is limited to the damage foreseeable at the time the contract was concluded. All other claims for damages are excluded.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find here. We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

11. Specific Cancellation Provisions (Shop-Owner Protective Terms)

In accordance with statutory requirements for the Right of Withdrawal, the following terms apply to all returns:

  • Return Shipping Costs: The consumer shall bear the direct costs of returning the goods. We do not provide free return labels unless explicitly stated otherwise.

  • Refund of Delivery Costs: If the customer chose a delivery method other than the cheapest standard delivery offered by us (e.g., Express Shipping), the resulting additional costs will not be reimbursed.

  • Compensation for Value Loss: The customer must pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary to check the condition, properties, and functionality of the goods (e.g., signs of wear, broken seals, or damaged original packaging).

  • Right of Retention: We reserve the right to withhold the refund until we have received the goods back in our warehouse or until the customer has provided valid proof that the goods have been sent back, whichever is earlier.

  • Exclusion for Customized Goods: The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
